The Controller will process the personal data provided by users through the electronic forms available on the website www.gonzalezbyass.com for the purposes identified below:

a) In relation to the “Contact form”:
Purpose: Management, review, and resolution of submitted inquiries, as well as sending commercial communications about our services, provided that the data subject has consented to the processing of their personal data for this purpose.

c) In relation to the “Newsletter subscription form”:
Purpose: Management of the subscription to our Newsletter, as well as sending information about the company, its activity, news of interest, and keeping you informed about products and services, provided that the data subject has consented to the processing of their personal data for this purpose. Legal basis: The data subject’s consent, which may be withdrawn at any time.
 

d) In relation to the “Make a reservation form”:
Purpose: Management of registration requests to place an online order, accounting, tax, and administrative management, carrying out satisfaction surveys to improve our products and services, conducting market research and commercial prospecting, consumer habit reports, statistical data and market trends, in order to offer you products and/or services that may be of interest to you, and compliance with legal obligations, provided that the data subject has consented to the processing of their personal data for this purpose.

When the data requested in the electronic forms is necessary in order to access specific functionalities of the website, GONZALEZ BYASS, S.A. will indicate that it is mandatory at the time the User’s data is collected, and failure to provide it will mean that the corresponding request cannot be processed.

Only when the User gives their express consent will their data be disclosed to the companies of the González Byass Group listed below and to Pedro Domecq S.A. de C.V. (with registered office at Presidente Masaryk 275, Polanco 11560, MEXICO CITY, United Mexican States, and RFC PDO 170316574, whose main activity is the production and marketing of wines and spirits), who will use them exclusively for the following purposes:

1.8 What security measures are applied?

GONZALEZ BYASS, S.A. adopts the security levels required by the GDPR appropriate to the nature of the data being processed at any given time. Notwithstanding the foregoing, the User must bear in mind that the security of systems is not impregnable and malicious actions by third parties may exist, although GONZALEZ BYASS, S.A. uses all means within its reach to prevent such actions. The transaction carried out through the Website will be invoiced by TIO PEPE WINE TOURISM COMPANY, S.L. (HOTEL BODEGA TIO PEPE), with which the contract is deemed to be entered into.

Use of the Website and the contracting of the services (the “Services”) offered on it implies acceptance by its users and/or customers (hereinafter both referred to indistinctly as the “User” or “Users”) of the General Terms and Conditions of Contracting, the Specific Conditions defined in the purchase process, and the Privacy Policy, which must also be accepted.

HOTEL BODEGA TIO PEPE reserves the right to change, modify, add, or remove any part of the Terms and Conditions at any time and to make changes to the Services without prior notice.

1. LEGAL AGE AND LEGAL CAPACITY

• The User declares that they are of legal age and have the legal capacity necessary to contract the Services offered on the Website in accordance with the Terms and Conditions, which they fully understand and comprehend.

2. ACCEPTANCE OF TERMS AND CONDITIONS

• Once the User has accessed the Website, in order to proceed with contracting the Services, they must follow all the indications and instructions set out in the purchase procedure, completing for these purposes the forms established for each Service, which shall imply reading and acceptance of all applicable General Terms and Conditions.
• By opting in to accept the General Terms and Conditions, the User confirms the booking with HOTEL BODEGA TIO PEPE, confirming the dates indicated in their reservation, the number of rooms and persons, and any other Service conditions detailed in the purchase procedure. The User undertakes to confirm the truthfulness and accuracy of the information provided, and any booking in which the user has provided false information shall be null and void.
  Likewise, by opting in to accept the General Terms and Conditions, the user authorizes HOTEL BODEGA TIO PEPE to charge the debit/credit card provided during the purchase process the amount corresponding to the reservation made, within the deadlines and on the terms indicated in these General Terms and Conditions (sections 4, 5, and 6 respectively).
• The Terms and Conditions and the price of the contracted reservation are those expressly determined in the purchase procedure. However, HOTEL BODEGA TIO PEPE reserves the right to correct any discrepancy arising in the rate calculated by the system. In this case, the hotel will notify the customer within a maximum period of 48 hours of the correct rate, and the customer may accept the change or cancel their reservation without charge.

3.  RATES AND BILLING

• Each of our rates shows the final price of the contracted services, including VAT, as well as any other applicable fees or taxes
• Prices are expressed according to the type of contracted service, number of persons, and the selected date
• Reservations of more than 5 rooms may be subject to supplements and special group conditions
• Our rates are valid only for the period indicated on the Website.
• With the exception of our junior suites, all our rooms are double rooms.
• A limited number of cribs and extra beds are available for guests. For this reason, it is important that, when making the reservation, you indicate your need for cribs or extra beds for children, as we cannot ensure their availability at the time of your arrival. Likewise, we cannot guarantee this service even with prior notice if there is no availability at the time it is requested. In such case, the customer will be informed through the channel used to make the reservation.
  Our extra beds are especially recommended for children because they include a thinner mattress than standard ones.
  The rates corresponding to accommodation for children in cribs or extra beds and/or breakfast service are those indicated on the website.
• If during the stay the hotel detects a discrepancy between the actual number of room occupants and/or the age of the guests and the data provided for that purpose by the Customer when making the reservation, and such discrepancy may entail an increase in the total price of the stay, the hotel will inform the Customer of such discrepancy and the corresponding amounts will be invoiced.

4. RESERVATIONS

4.1. Selected Products

• The rooms and other services you wish to purchase must be selected and added to the shopping bag by clicking on the corresponding icon.
• The shopping bag will contain the check-in and check-out dates of your reservation, the number of rooms and persons, and any other Service conditions detailed in the purchase procedure. The stated price includes taxes.

4.2. Billing details and sending of purchase confirmation

• Your billing details (first name, surname, email, and contact telephone number) as well as the delivery details will appear on screen, according to the data you yourself entered when registering.

4.3. Order Confirmation and Payment

• Once the purchase order has been completed, a summary identifying the reservation made and its total price (taxes included) will be displayed. The reservation must be confirmed by clicking the "MAKE RESERVATION” button and accepting the General Terms and Conditions of Purchase.
• In order to confirm your reservation and make payment, we will ask you for a valid credit or debit card number (see "Accepted Payment Methods")
• Once the transaction has been confirmed, notice will be provided through the website itself. Likewise, an email message will be sent to the address indicated by you, containing a description confirming the dates indicated in your reservation, the number of rooms and persons, and any other Service conditions corresponding to the purchase made.
• If at the time of reservation confirmation we detect that some of the requested rooms or services are not available, the customer will be notified immediately and the amount paid corresponding to that room or service will be refunded.
• Payment for your reservation will be made at the time of booking or, where applicable and unless you previously cancel the reservation, once the free cancellation period that may apply as indicated in section 6 of these General Terms and Conditions of Contracting (MODIFICATION AND CANCELLATION OF RESERVATIONS. NO SHOW) has elapsed, by charging the card provided by you.

5. ACCEPTED PAYMENT METHODS

To confirm your reservation, we will ask you for a valid credit or debit card number. Depending on the type of Rate and how far in advance the reservation is made, the applicable payment methods and deadlines will vary, and may be as follows:

• Payment by credit or debit card. This payment method may be made in the following ways:
• Payment at the time of reservation confirmation
• Deferred payment, unless you previously cancel the reservation, once the free cancellation period applicable to the reservation made has elapsed, as indicated in section 6 below of these General Terms and Conditions of Contracting.
• In the event of cancellation or modification of the reservation after the applicable free cancellation period has ended, or in the event of a “no show”, the amounts paid will be retained (in whole or in part, as appropriate) as a penalty, as indicated in section 6 below of these General Terms and Conditions of Contracting.

6. MODIFICATION AND CANCELLATION OF RESERVATIONS. NO SHOW.

• The User may cancel or modify the reservation, in writing and by contacting infohotel@tiopepe.com, in the cases, within the periods, and under the conditions indicated below. The validity of the requested cancellation or modification will be subject to confirmation by the hotel through the same means.
• The conditions for modification, cancellation, or no show of the reservation will be those stated in the purchase process specified on the Website and may vary according to the type of room, the type of applicable rate, and the reserved dates, always being shown in the sales conditions of the reserved rate.
• Reservations made under the General Rate allow free cancellation as indicated below:

1. For stays on Sundays, Mondays, Tuesdays, Wednesdays, and Thursdays: Up to  three (3)  days before the arrival date at 00:00 CET – Central European Time.
2. For stays on Fridays and Saturdays: Up to seven (7) days before the arrival date at 00:00 CET – Central European Time.
   
   Cancellations made less than the period indicated in sections a) and b) above are not permitted.  Cancellations made less than three or seven days in advance, as applicable, will incur a penalty of 100% of the total amount of the stay.

• On special dates, understood as:

1. The Friday prior to and the corresponding weekend of the MotoGP Grand Prix held at the Circuito de Velocidad de Jerez de la Frontera
2. Holy Week (from Palm Sunday to Easter Sunday)
3. Horse Fair
4. National public holidays, Andalusian regional public holidays, or local public holiday weekends in Jerez de la Frontera
   
   Reservations made allow free cancellation up to  twenty (20)  days before the start of the corresponding event at 00:00 CET – Central European Time. Cancellations made less than twenty (20) days in advance will incur a penalty of 50% of the total amount of the stay. Cancellations made less than ten (10) days before the start date of the corresponding event are not permitted and will incur a penalty of 100% of the total amount of the stay.

• If when making your reservation you have opted for a Non-refundable rate, the penalty for cancellation of the reservation will be 100% of the total amount of the stay.
• You may consult the cancellation and/or modification conditions associated with your rate in your reservation confirmation document.
• The following shall be understood as a modification of the reservation:

1. Modification of the check-in and/or check-out date
2. Modification of the number of contracted rooms

• No show: A no show is deemed to occur when the customer does not arrive at the Hotel on the check-in date and has not cancelled the reservation. In the event of a no show,  HOTEL BODEGA TIO PEPE will retain 100% of the amount paid.

7.  VALIDITY OF OFFERS

• Offers on the Website shall only be valid for as long as they remain accessible to Users for effective contracting through the established purchase process.
• If HOTEL BODEGA TIO PEPE must cancel the reservation due to a fortuitous event or force majeure, the reservation will be cancelled without any right to claim or compensation by the customer. In such case, the customer will be informed through the channel used to make the reservation.

8.  OTHER CONDITIONS

• Upon arrival at the Hotel, the means of reservation confirmation will always be the reservation confirmation email received. The User undertakes to carry the confirmation email and present it at check-in, accepting that if this document is not presented, the reservation conditions cannot be guaranteed.
• On the arrival date, the room will be available to guests from 15:00. On the departure date, guests must vacate the room before 12:00
• Upon check-in, all guests must present a valid photo identification document (ID card, national ID card, driver’s license, or passport). A valid credit card will also be required as a guarantee for the stay.
• Pets are not allowed at this establishment, with the exception of guide dogs.
• Hotel Bodega Tío Pepe is a smoke-free hotel, and therefore smoking is strictly prohibited in the hotel’s indoor common areas and in all rooms. Smoking is permitted on room balconies, in the garden, and on private and shared terraces.
• The hotel is not responsible for the loss or theft of cash, jewelry, or other valuables that are not deposited for safekeeping in the safe located at reception.
• The User accepts and undertakes to use the room and the Hotel facilities appropriately. Any behavior contrary to good customs and public order may allow the Hotel to request that the User leave the establishment without any compensation or refund if a charge has already been made. The Customer shall be responsible for any damage, breakage, or other harm that may occur at Hotel Bodega Tío Pepe and that is caused by them or any of their companions.
• Bringing food into the Hotel by guests will require the prior signing of the liability waiver document that will be provided to them at the Hotel reception.

9. PERSONAL DATA PROTECTION

• HOTEL BODEGA TIO PEPE processes your personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC, and Organic Law 3/2018.

10.   MODIFICATION OF THE GENERAL TERMS AND CONDITIONS OF CONTRACTING

11. APPLICABLE LAW AND COMPETENT JURISDICTION

• These General Terms and Conditions are subject to and shall be governed in accordance with the laws of Spain.
• The purchase system is subject to the laws in force in Spain; therefore, sales transactions shall be deemed to have been carried out at the registered office of HOTEL BODEGA TIO PEPE: Calle Manuel Mª González 12, 11403 Jerez de la Frontera (Cadiz) - Spain.
• In compliance with Law 7/2017 of 2 November, we inform you that our company is not affiliated with any alternative consumer dispute resolution entity and does not currently undertake to participate in proceedings before an ADR entity.

ADMISSION CONDITIONS

As a general rule, minors under 18 years of age must stay at the hotel accompanied by their parents, guardians, or adults duly authorized by them. Hotel staff may require the relevant documentation identifying the adults as their parents/guardians or authorized persons.

Access will not be permitted to persons behaving violently, who may cause disturbance to the public or users, or who may affect the normal operation of the hotel activity.

Access will not be permitted to anyone wearing clothing or displaying symbols that incite violence, racism, or xenophobia.

Visits by unregistered persons to guest rooms are not permitted.

RULES OF CONDUCT AND OPERATION

Smoke-free space. Smoking is not permitted in the hotel, except in outdoor areas, in accordance with Law 7/2012 regulating the prohibition of smoking in public places. We thank our guests for respecting it.

Damage and deterioration caused to the hotel’s facilities and/or property through misuse or negligence by guests will be charged to their account.

No type of animal or pet is allowed in the hotel, except for guide dogs for guests who require them.

The sale of food and beverages is the exclusive privilege of Hotel Bodega Tío Pepe; therefore, we kindly ask that no food or drink not originating from the establishment be brought in, and that no cooking take place in the rooms. Likewise, food and beverages may not be taken from the restaurant. The hotel offers a picnic and/or room service for your convenience.

All guests are kindly requested to be properly dressed in common areas, corridors, and the restaurant. Swimwear, bare torsos, and bare feet are not permitted.

For your safety, children must be accompanied by an adult when using the elevators.

For the common good and everyone’s rest, guests are requested to observe quiet hours between 00:00 and 08:00.

Hanging towels or garments on balcony railings is not permitted. Portable drying racks are available at reception for this purpose.

ADDITIONAL INFORMATION

The availability of change for €500 and €200 banknotes is not guaranteed. Personal checks are not accepted. Cash payments over €2,500 will not be accepted.

The hotel is not responsible for cash, jewelry, or valuables that are not deposited for safekeeping in our safety deposit boxes.

Rooms are cleaned from 09:00 to 14:00. Rooms whose guests have not left before that time will not be cleaned. Replacement towels and toiletries may be requested at reception.

Check-out time is until 12:00.
